PharKeep Media – Terms of Use

Welcome to PharKeep's Media Content Management System (CMS) (“we,” “us,” or “our”). By accessing or using PharKeep MediaCMS (“Service”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, uploading content, or otherwise using PharKeep Media, you agree to comply with these Terms and all applicable laws and regulations.

2. User Accounts

  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You are responsible for all activities that occur under your account.

3. User Content

  • You retain ownership of content you upload, but grant PharKeep Media a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Service.
  • You are solely responsible for your content and must have all necessary rights to upload it.
  • Content must not infringe on any third-party rights, including copyright, trademark, privacy, or publicity rights.

4. Prohibited Conduct

You agree not to:

  • Upload unlawful, harmful, or offensive content.
  • Violate copyright or intellectual property laws.
  • Attempt to gain unauthorized access to the Service or other users’ accounts.
  • Distribute viruses or malicious code.

5. Copyright and Fair Use

  • PharKeep Media respects intellectual property rights. If you believe your copyright is infringed, contact us to file a complaint.
  • If you use copyrighted content under fair use, you are responsible for ensuring your use complies with applicable law. A fair use disclaimer does not guarantee protection from copyright claims.

6. Disclaimers and Limitation of Liability

  • The Service is provided “as is” and “as available.” We make no warranties regarding accuracy, reliability, or availability.
  • PharKeep Media is not liable for:
    • Errors or inaccuracies on the Service.
    • Personal injury or property damage resulting from your use of the Service.
    • Unauthorized access to or use of our servers.
    • Interruption or cessation of the Service.
    • Viruses or malicious code transmitted by third parties.
    • Any content posted by users or third parties.
  • Our total liability for any claims relating to the Service is limited to the greater of: (a) the amount paid by you to PharKeep Media in the 12 months prior to the claim, or (b) $500.

7. Indemnity

You agree to defend, indemnify, and hold harmless PharKeep Media and its affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights.

8. Modifications to Terms

We may update these Terms at any time. Changes will be posted on this page. Continued use of the Service after changes means you accept the new Terms.

9. Termination

We may suspend or terminate your account if you violate these Terms or applicable laws.

10. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in the courts located in Orange County, California.
